Terms of payment are within Stock Yards' sole discretion, and unless otherwise agreed to in a writing signed by Stock Yards, payment must be received by Stock Yards prior to Stock Yards' acceptance of an order from you. Payment for products may be made by credit card or some other prearranged payment method accepted by Stock Yards unless Stock Yards has agreed to credit terms in writing. No order shall be binding upon Stock Yards until accepted by Stock Yards. Product and pricing data may change without notice. Final pricing on your order is effective on the date that payment for the order has been received. Separate charges for shipping and handling charged by Stock Yards are provided below. You are responsible for sales and all other taxes associated with the order, as set forth below. Taxes on goods shipped to Canada may be imposed and are your sole responsibility. You agree to indemnify and hold Stock Yards free and harmless from and against the imposition and payment of all U.S. and Canadian taxes, whether or not they are stated in any invoice for products shipped to you. Stock Yards, at its option, may at any time, separately bill you for any taxes not included in Stock Yards' invoice, Customs' bill, or otherwise paid for you and you shall pay such taxes, or in lieu thereof, shall provide Stock Yards with a tax exemption certificate acceptable to the applicable taxing authorities. If any such certificate furnished to Stock Yards is held invalid or if the sale is otherwise found to be taxable, you agree to pay promptly any taxes (plus interest) found due, but not collected as a result of Stock Yards' reliance upon your certificate.

Standard shipping charges are based on the number of items purchased. The shipping charges listed include delivery within 5-6 working days to addresses within the continental 48 states. Shipments to Alaska, Hawaii and Canada* are available for an additional charge. Contact customer service at 1-800-621-3687 for details. We cannot ship to other foreign, P.O. Box, APO, FPO or Puerto Rico addresses. For exact day delivery, or delivery in less than 5-6 working days, expedited air delivery is available for an additional charge. Your perishable package will be delivered and released by a UPS or Federal Express driver. Please make arrangements to receive your package. All orders are shipped DRIVER TO RELEASE - NO SIGNATURE REQUIRED. This means the package will be delivered to the address without obtaining a signature. Please be sure to alert the recipient that a perishable food gift or delivery is coming via FedEx or UPS.

Attention Gift Givers: Please double-check your addresses and notify the recipient that a perishable package will be arriving. Damage due to incorrect or incomplete addresses will void our Guarantee, which is available at this link, incorporated into these Terms of Sale and made a part hereof. In addition, our Guarantee does not apply if the gift recipient is not present to receive the package.

Unless otherwise agreed to in a writing signed by Stock Yards, delivery of products ordered from this Site shall be made in accordance with Stock Yards' delivery policies in effect on the date of shipment. Risk of loss and title to the products shall pass from Stock Yards to you on shipment from Stock Yards' facilities. Stock Yards shall not be liable for any delays in delivery beyond the reasonable control of Stock Yards including, but not limited to, delays caused by unavailability or shortages of the products from Stock Yards' suppliers, natural disasters, acts of war, acts or omissions of you, fire, strike, riot, governmental interference, unavailability or shortage of materials, labor, telecommunications, fuel or power through normal commercial channels at customary and reasonable rates, failure or destruction of plant or equipment arising from any cause whatsoever, transportation failures or computer-related or transmission failures.

Our prices do not include duties or value-added taxes. If assessed, these charges are the responsibility of the package recipient, who will be billed for them by the local Customs office. Please keep this in mind when shipping a gift item to Canada. If the ship-to address is in one of the states listed below, please add the state sales tax indicated. If additional local taxes apply, or if tax rates change, we are required to collect the tax in effect at the time of your order. Shipment of any products outside of the United States may require a valid export license. You may not use the Site or export any contents of the Site in violation of U.S. export laws and regulations. You agree to defend, indemnify and hold harmless Stock Yards for any violation of any United States export restrictions. By using this Site you represent and warrant that you are not located in, under the control of, or a national or resident of any country on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Deny Orders or Denied Persons List.

This Site (excluding linked sites) is controlled by Stock Yards from its offices within the state of Illinois, United States of America. You agree that any claim relating to the Site content shall be governed by the internal substantive laws of the State of Illinois without regard to its conflict of law principles.

Any failure by Stock Yards to enforce any of its rights under these Terms of Sale or under applicable law shall not constitute a waiver of such rights.

You acknowledge that you have read these Terms of Sale, understand them and agree to be bound by its terms and conditions. You further agree that these Terms of Sale and the Terms of Use, which are available at this link, are the complete and exclusive statement of the agreement between you and Stock Yards. If any provision of the Terms of Sale shall be deemed unlawful by a court of competent jurisdiction, or for any reason unenforceable, then that provision shall be deemed severed from these Terms of Sale and shall not affect the validity and enforceability of any remaining provisions hereunder.
